Real Estate agents are there to sell houses, people come to the agent to buy a house not because the agent has auburn hair or because he is smiling. I have asked many agents why they do it…the answers range from; because the company requires it, simple I don’t knows, to I need it to stand out from the competition. (If all the competition is doing the same thing, how does that set you apart?) There are many people who have their own businesses and are sole-propritors from hair dressers to contractors, pool cleaners, consultants and lawyers but they don’t plaster their headshot all over everything that relates to their business. There could be some reasons why they don’t. Sending the wrong image of self importance is one. Another reason is aging. As people get older they become less satisfied with the way they look, a little less hair, and few saggy chins, smile lines that have turned into furrows. Real Estate agents face this problem head on…they just leave the same picture on their business card for their entire 25 year career, a nice youthful look. Finally, since marketing materials cost money and space is at a premium maybe they think it is better to use that space showing the product or benefit to the customer instead of a self portrait.

The second tradition that seems more like a bad habit is to have flyers and doorhanger bags strewn all over a neighborhood, and scattered on your prospective clients front porch. If it is a particularly popular neighborhood this means you find this stuff at your doorstep 3-5 times a week thanks to 10 or 15 different agents! I’ve even seen this stuff delivered on Sundays. How many people pick up those flyers while vowing to NEVER do business with the agents who turn their yard into a landfill’s delight! It also is baffling that real estate agents see themselves on the same level as pizza places, gardeners, and the local handy man, all of whom market this way too. I have never seen a professional lawyer, doctor or accountant, market themselves in this manner.

At some point one’s values should win over tradition. Respecting the client (and their front porch), making the client’s/prospect’s priorities your priorities must become the focus of a successful career. Common sense and creativity should come together with customer service, and bad habits should be broken, even if all the competition plans to carry on.

I would like to encourage all real estate agents that might read this. Be a leader, put a picture of a door knocker or house on your business card. I know its a radical idea, but take the challenge! Wouldn’t that space be better used talking about your specialties or how long you’ve been in business? Who knows, you might even generate some goodwill by not cluttering up a porch with flyers that go straight into the trash.

First, and foremost, I will highlight some of the most important points of Texas Cash Out loans:

  • A person can only have one homestead propety
  • Any Texas Cash Out loan is limited to a maximum of 80% LTV
  • Only one Texas Cash Out Loan may be given in any 12 month period
  • A 12 day “cooling off period” , known as the 12 day letter, is required on every transaction
  • A maximum of 3% of the loan amount can be charged to the customer which includes all closing costs
  • Once a Home Equity loan is taken on a persons homestead, all transactions following from that point on (with the exception of the sale of the property) are considered Texas Cash Out loans.
  • In regards to the last point, just to further clarify, even if you are refinancing the balance of a current Cash Out loan and not getting any new cash out, it is still considered a Texas Cash Out loan. The rule is quite simple, once a cash out, always a cash out loan.
  • Every owner of the property must given the HUD-1 settlement statement for review at least 24 hours prior to closing your loan

The Process
The process of obtaining a Texas Cash Out loan is really only slightly different than a home equity loan or refinance loan in any other state. Yes, the documentation and requirements are different, but the process itself is very similiar.

Before applying to obtain a cash out loan in Texas, you have to realize that you are limited, by State Law, to a maximum of 80% LTV for the new loan. So, if your house is worth (appraised value) of $200,000, then the maximum loan you can get, including any/all closing costs involved is $160,000. So, if you currently owe more than $160k on your current mortgage on the house, you wiil not be able to obtain a home equity loan in Texas. I only say this to save you some time and effort if it is your desire to get cash out or obtain a debt consolidation loan on your homestead property. You can also use this figure to estimate as to how much cash will be available to you from your new loan as a maximum amount.

You can also expect that your options will be more limited than if you were looking to simply do a rate/term refinance (refinance the balance of an existing loan) or purchase a home. Your options are more limited because not all lenders will do Texas Cash Out loans. The reasons are a combination of them not willing to adjust to the more stringent documentation requirements of the Texas Home Equity loan, some are simply because they believe the documentation and legal restrictions are simply too much of an additional burden on them to offer these types of loans. Understand that while the process itself is not that different from the consumer stand point, from a lenders stand point the differences are more unique and do require the lenders to essentially have a seperate set of documents and, most likely, additional staffing just to manage and keep up with any/all changes to Texas Law regarding these loans.

The application process will be essentially the same as any other mortgage loan. You contact your mortgage broker or one or more mortgage lenders, give them your information and you are on your way. Once your applciation and credit have been evaluated, you will, as in any other mortgage transaction, receive a Good Faith Estimate and Truth in Lending within 3 days of you giving your information on an application. This can be used to compare your offers and to help you make an educated decision as to which lender/broker to go with. Once you have made the decision as to which company you will use, you will then be sent a disclosure package which will contain initial RESPA disclosures, other state required forms, lender required forms, and a list of items that you will need to provide along with these documents in order to get your loan completed. I have another section for disclosures (posting to be completed shortly), so I won’t go into the specific disclosures other than the ones that apply strictly to Texas Cash Out loans.

You can expect your loan to take longer than a standard mortgage loan. The reason is that Texas Law requires a 12 day cooling off period, so, your transaction cannot take place for at least 12 days after you sign that document which essentially states your rights as a consumer. In most cases, the delay may only be a couple of days as during that time period the normal other items can be taken care of simultaneously, ie., the appraisal, preliminary title report, and the gathering of the required documents from you, the consumer. I am simply saying that if you are anticipating your loan to done inside of two weeks, then you know now, that it is simply not possible.

Once your documents are in the hands of the company you chose, and the appraisal and title work are done, then the loan is underwritten and final approval is given as in any other mortgage transaction. At this time, there may be some outstanding conditions, or other documentation that may be required to be provided due to individual circumstances and/or is something was simply left out or missing from your file. Once those documents are provided, and your loan is cleared of all pending conditions or documentation, then the closing time/date is set and your documents are sent to the title company which prepares the documents for closing.

One item of note here, Texas Cash Out loans are required to be closed at a title company location, they cannot be closed in the customer’s home as some mortgage transactions are. This is strictly forbidden by Texas Home Equity Lending Laws, so don’t expect anyone to come to your home out of convience for you to close your loan, it just won’t happen in Texas.

Additionally, once your closing is set, it is a requirement that each owner of the property be given the HUD-1 settlement statement at least 24 hours prior to closing the loan. If any changes are made to the settlement statement before closing, then another 24 hours must be allowed before closing the loan, again, this is not optional. The reality is, in my opinion, this is actually a very good thing and one of the better laws that Texas has pertaining to home equity lending.

The fact that the consumer gets to see the actual HUD-1 settlement statement a day before the loan closing gives them the opportunity to ask questions and to make certain that everything is correct OR as stated on their initial Good Faith Estimate. This means that there can be no surprises at the closing table. If it were up to me, all consumers would get the HUD-1 one day prior to closing, that way all questions can be eliminated and it would make the closing go that much smoother as you would already be aware of exactly what the settlement statement has on it before you get to the closing table – that is for another discussion.

After you sign the documents there is a 3 day right of recission, as on all mortgage refinance transactions on owner occupied homes. This means, quite simply that once you sign, you are given copies of all documents and given 3 business days (Saturdays count) to review all documents and make your final decision as to whether or not you want the loan. Keep in mind that the decision is YES, unless you decide to say no. So, if you sign documents on Monday, you are given until midnight of Thursday to cancel the transaction, you loan funds on Friday. Friday is too late to cancel. So, if you are going to cancel, make cetain that you notify the title company as soon as possible but you only have until Thursday to do it.

Once your loan funds and you are given your proceeds (cash or payoff sent off), then you are done. Keep in mind that you cannot complete another Texas Cash Out loan for 12 months (1 year) to the day of your loan funding, without exception. You can’t even sign the initial disclosures on a new loan until after that 1 year is up. The reason I mention this is so that you realize that you only get one shot a year to do a loan like this, make sure you get what you need the first time because it will be a long time before you can do it again.

The Complexity of Simplicity

Complexity rises spontaneously in nature through processes such as self-organization. Emergent phenomena are common as are emergent traits, not reducible to basic components, interactions, or properties.

Complexity does not, therefore, imply the existence of a designer or a design. Complexity does not imply the existence of intelligence and sentient beings. On the contrary, complexity usually points towards a natural source and a random origin. Complexity and artificiality are often incompatible.

Artificial designs and objects are found only in unexpected (“unnatural”) contexts and environments. Natural objects are totally predictable and expected. Artificial creations are efficient and, therefore, simple and parsimonious. Natural objects and processes are not.

As Seth Shostak notes in his excellent essay, titled “SETI and Intelligent Design”, evolution experiments with numerous dead ends before it yields a single adapted biological entity. DNA is far from optimized: it contains inordinate amounts of junk. Our bodies come replete with dysfunctional appendages and redundant organs. Lightning bolts emit energy all over the electromagnetic spectrum. Pulsars and interstellar gas clouds spew radiation over the entire radio spectrum. The energy of the Sun is ubiquitous over the entire optical and thermal range. No intelligent engineer – human or not – would be so wasteful.

Confusing artificiality with complexity is not the only terminological conundrum.

Complexity and simplicity are often, and intuitively, regarded as two extremes of the same continuum, or spectrum. Yet, this may be a simplistic view, indeed.

Simple procedures (codes, programs), in nature as well as in computing, often yield the most complex results. Where does the complexity reside, if not in the simple program that created it? A minimal number of primitive interactions occur in a primordial soup and, presto, life. Was life somehow embedded in the primordial soup all along? Or in the interactions? Or in the combination of substrate and interactions?

Complex processes yield simple products (think about products of thinking such as a newspaper article, or a poem, or manufactured goods such as a sewing thread). What happened to the complexity? Was it somehow reduced, “absorbed, digested, or assimilated”? Is it a general rule that, given sufficient time and resources, the simple can become complex and the complex reduced to the simple? Is it only a matter of computation?

We can resolve these apparent contradictions by closely examining the categories we use.

Perhaps simplicity and complexity are categorical illusions, the outcomes of limitations inherent in our system of symbols (in our language).

We label something “complex” when we use a great number of symbols to describe it. But, surely, the choices we make (regarding the number of symbols we use) teach us nothing about complexity, a real phenomenon!

A straight line can be described with three symbols (A, B, and the distance between them) – or with three billion symbols (a subset of the discrete points which make up the line and their inter-relatedness, their function). But whatever the number of symbols we choose to employ, however complex our level of description, it has nothing to do with the straight line or with its “real world” traits. The straight line is not rendered more (or less) complex or orderly by our choice of level of (meta) description and language elements.

The simple (and ordered) can be regarded as the tip of the complexity iceberg, or as part of a complex, interconnected whole, or hologramically, as encompassing the complex (the same way all particles are contained in all other particles). Still, these models merely reflect choices of descriptive language, with no bearing on reality.

Perhaps complexity and simplicity are not related at all, either quantitatively, or qualitatively. Perhaps complexity is not simply more simplicity. Perhaps there is no organizational principle tying them to one another. Complexity is often an emergent phenomenon, not reducible to simplicity.

The third possibility is that somehow, perhaps through human intervention, complexity yields simplicity and simplicity yields complexity (via pattern identification, the application of rules, classification, and other human pursuits). This dependence on human input would explain the convergence of the behaviors of all complex systems on to a tiny sliver of the state (or phase) space (sort of a mega attractor basin). According to this view, Man is the creator of simplicity and complexity alike but they do have a real and independent existence thereafter (the Copenhagen interpretation of a Quantum Mechanics).

Still, these twin notions of simplicity and complexity give rise to numerous theoretical and philosophical complications.

Consider life.

In human (artificial and intelligent) technology, every thing and every action has a function within a “scheme of things”. Goals are set, plans made, designs help to implement the plans.

Not so with life. Living things seem to be prone to disorientated thoughts, or the absorption and processing of absolutely irrelevant and inconsequential data. Moreover, these laboriously accumulated databases vanish instantaneously with death. The organism is akin to a computer which processes data using elaborate software and then turns itself off after 15-80 years, erasing all its work.

Most of us believe that what appears to be meaningless and functionless supports the meaningful and functional and leads to them. The complex and the meaningless (or at least the incomprehensible) always seem to resolve to the simple and the meaningful. Thus, if the complex is meaningless and disordered then order must somehow be connected to meaning and to simplicity (through the principles of organization and interaction).

Moreover, complex systems are inseparable from their environment whose feedback induces their self-organization. Our discrete, observer-observed, approach to the Universe is, thus, deeply inadequate when applied to complex systems. These systems cannot be defined, described, or understood in isolation from their environment. They are one with their surroundings.

Many complex systems display emergent properties. These cannot be predicted even with perfect knowledge about said systems. We can say that the complex systems are creative and intuitive, even when not sentient, or intelligent. Must intuition and creativity be predicated on intelligence, consciousness, or sentience?

Thus, ultimately, complexity touches upon very essential questions of who we, what are we for, how we create, and how we evolve. It is not a simple matter, that…

TECHNICAL NOTE – Complexity Theory and Ambiguity or Vagueness

A Glossary of the terms used here

Ambiguity (or indeterminacy, in deconstructivist parlance) is when a statement or string (word, sentence, theorem, or expression) has two or more distinct meanings either lexically (e.g., homonyms), or because of its grammar or syntax (e.g., amphiboly). It is the context, which helps us to choose the right or intended meaning (“contextual disambiguating” which often leads to a focal meaning).

Vagueness arises when there are “borderline cases” of the existing application of a concept (or a predicate). When is a person tall? When does a collection of sand grains become a heap (the sorites or heap paradox)?, etc. Fuzzy logic truth values do not eliminate vagueness – they only assign continuous values (“fuzzy sets”) to concepts (“prototypes”).

Open texture is when there may be “borderline cases” in the future application of a concept (or a predicate). While vagueness can be minimized by specifying rules (through precisifaction, or supervaluation) – open texture cannot because we cannot predict future “borderline cases”.

It would seem that a complexity theory formalism can accurately describe both ambiguity and vagueness:

Language can be construed as a self-organizing network, replete with self-organized criticality.

Language can also be viewed as a Production System (Iterated Function Systems coupled with Lindenmeyer L-Systems and Schemas to yield Classifiers Systems). To use Holland’s vocabulary, language is a set of Constrained Generating Procedures.

“Vague objects” (with vague spatial or temporal boundaries) are, actually, best represented by fractals. They are not indeterminate (only their boundaries are). Moreover, self-similarity is maintained. Consider a mountain – where does it start or end and what, precisely, does it include? A fractal curve (boundary) is an apt mathematical treatment of this question.

Indeterminacy can be described as the result of bifurcation leading to competing, distinct, but equally valid, meanings.

Borderline cases (and vagueness) arise at the “edge of chaos” – in concepts and predicates with co-evolving static and chaotic elements.

(Focal) meanings can be thought of as attractors.

Contexts can be thought of as attractor landscapes in the phase space of language. They can also be described as fitness landscapes with optimum epistasis (interdependence of values assigned to meanings).

The process of deriving meaning (or disambiguating) is akin to tracing a basin of attraction. It can be described as a perturbation in a transient, leading to a stable state.

Tiscali’s Financial Troubles Affecting Operations

More than 1.8 million customers in the UK face the risk of losing their broadband connection as Tiscali gets into deeper trouble over its debts. This Italy-based service provider is going through a rough patch due to its huge liabilities, and this is likely to affect its broadband operations directly in the near future.

Ernst & Young, an independent auditor, has warned Tiscali about its present situation and has clearly stated the gravity of the matter by confirming that the only way out for Tiscali is to successfully renegotiate the debts with its lenders.

Tiscali has assured that it already has a plan to settle the debts, and that it intends to discuss the same at the shareholder meeting slated to take place before May.

According to a Tiscali spokesperson, the company will continue to function as usual in both the UK and Italy, and that neither the customers nor the suppliers have anything to worry about.

Recently all customers who had their accounts on Tiscali’s screaming.net domain found that their accounts were frozen because the company did not renew the domain name.

It is quite clear that Tiscali’s survival is at risk, and as news of its service failures spread, more customers could abandon the company, which will only make the trouble more severe. Wash Your Sheets once a Week and Sleep Better

Sleep is such a great thing. It can make the biggest difference in having an okay day and a great day. If you really want to enhance this feeling there are a couple things you can do to really give a most restful sleep, like putting scented oils on your pillow cases and having scented candles all over your room that you can turn on for about half an hour while you read your favorite book, don’t forget to turn off your light and the candles as well, and have a really good night.
